DOL Releases Final Overtime Rule
Today, the Department of Labor (DOL) released its final overtime rule,
which will go into effect on 12/01/16. The final rule will raise the
salary threshold under which virtually all workers are guaranteed
time-and-a-half pay whenever they work more than 40 hours in any given
week. Although the rule will raise the salary threshold to help a total
of 4.2 million salaried, non-manufacturing workers nationwide, there
remain certain employees who will not receive overtime protection under
the new rule. For example, the DOL issued a non-enforcement policy lasting
until 03/19 for certain health care providers that provide disability
services and are primarily Medicaid-funded. While acknowledging that an
updated salary threshold was necessary, a disability services group
previously explained that the proposed rule was not practical because of
their limited funding. These providers have called on Congress to increase
Medicaid funding for disability services providers in order to accommodate
the new rule.
